Ongewenste nationaliteiten / 2: allégeance perpétuelle

Hoe zit het nu precies met de dubbele nationaliteit van Marokkanen, i.c. Aboutaleb? De meeste websites nemen klakkeloos over dat Marokkanen geen afstand kunnen doen van hun nationaliteit, terwijl anderen stellen dat juist wel kan en dat Aboutaleb dus liegt.

Nu is het zo dat Marokko de zogenaamde Code de la Nationalité Marocaine kent. Deze is recent herzien hetgeen met name consequenties heeft voor vrouwen. Voor het punt van dubbele nationaliteit is het niet zo van belang. Uit artikel 19 e.v. volgt dat Marokkanen wel degelijk van hun nationaliteit kunnen afkomen per beschikking. Dat wil zeggen dat zij daartoe een verzoek moeten indienen en de beschikking om hun nationaliteit af te nemen, zal dan gepubliceerd worden.

Degenen die stellen dat Aboutaleb liegt, richtenzich daar op maar dit is niet het hele verhaal. Van belang is om te weten dat Marokko vanaf de 19e eeuw steeds meer onder Europese politieke en economische invloedssfeer terechtkwam. Ook het Europees recht raakte verbreid in Marokko. In het Verdrag van Madrid van 1880 kwamen Marokko en een aantal Europese staten en de Verenigde Staten in artikel 15 het beginsel van de allégeance perpétuelle overeen: Marokkanen blijven altijd Marokkaans staatsburger en hun kinderen ook waar ze zich ook bevinden of welke andere nationaliteit ze ook aannemen (Met dank aan L. De bovenstaande info komt daar vandaan; de uiteindelijke weergave is mijn verantwoordelijkheid). In de praktijk betekent dit dat de Marokkaanse overheid niemand het staatsburgerschap ontneemt, gebaseerd op dit verdrag met Europese landen en de VS.

Rania, Queen of Jordan, at work: Development, gender and extremism

Jordan queen, Rania, has delivered a speech at the eighth Jeddah Economic Forum. In this speech she emphasized the importance of building a developed future for Muslims and Middle Eastern generations, correcting the false images of them in the West through reforms in the region for example with regard to genderissues.

She called upon moderate Muslims to stand up and reject extremism and highlighted the relationship between free choice and Islam by stating that Islam does not force upon women to wear the veil. She criticized the US role in the Middle East and the prejudices of Westerners towards Arab people but also stated that Arabs themselves contributed to these prejudices. She questioned the lack of progress and pleaded for reform based upon Arab traditions, Islamic tradition and non-Muslim rolemodels:

She invoked the golden age of Islam when Arab civilization was more open to the wisdom of others. “The Arab ancestors welcomed new ideas from foreign lands and combined them with their own experiences to push boundaries of knowledge farther,” she said.

The queen referred to two important non-Muslim moral leaders of the 20th Century — Mahatma Gandhi and Martin Luther King, Jr., who revolutionized methods of nonviolent protest and boycotts through mass participation and personal sacrifice.

These “leaders of humanity”, as she called them, managed to create profound change in their societies by meeting the violence of the state with nonviolent popular uprising. She quoted King’s famous line: “There comes a time when one must take a position that is neither safe nor popular, but because conscience tells him it is right.”

“And let us not forget the great words of our own religion,” she added. “God said in the Holy Qur’an ‘God will not change a nation until they change themselves,’” the queen said. “Today we must ask ourselves, where is that spirit?”

Claiming Equal Citizenship » Morocco Amends Nationality Code

Great News – On January 18, 2007, the Moroccan Government passed a bill to reform the country’s nationality code which will enable women the right to pass on their nationality to their children. Although the bill has passed at the Cabinent level, it is awaiting approval from the Parliament, which hopefully will come next week.

The law was amended in line with the country’s family code, the Moudawana, meaning that only Moroccan women who have married Muslim men in accordance with the Moudawana would benefit.

The Moroccan Minister of Communication, Nabil Benabdallah, is quoted in The Magharebia, a news source reporting on the Maghreb region, as saying, “the bill is an important step towards the emancipation of the Moroccan woman, after the reform in the family code (mudawana). Thus, the child will acquire Moroccan citizenship even if the father is a foreigner, but only if he is a Muslim and married according to the rules of the mudawana.” (more…)

Meten met twee maten: Liberalen en Islamisten in Egypte

Er was de laatste tijd terecht veel aandacht voor de Egyptische blogger Kareem die is veroordeeld tot vier jaar cel wegens belediging van de islam en de Egyptische president. Veel informatie hierover kun je vinden bij Global Voices Online. Deze veroordeling zet terecht Egypte in de spotlights als een autoritaire dictatuur en protest daartegen is noodzakelijk en kan naar mijn mening ook nuttig zijn.

Marc Lynch op Abu Aardvark wijst echter op een belangrijk punt. Vorig jaar en enkele weken terug heeft de Egyptische overheid diverse (vermeende) aanhangers van de Egyptische Moslimbroederschap opgepakt, gevangen gezet, hun bankrekeningen bevroren en hun zaken gesloten (zonder enige vorm van proces). Dat haalt hier nauwelijks de kranten of weblogs, behalve als het om een kopstuk gaat. De repressie tegen de islamisten is net zo goed een zaak van democratie en vrijheid van meningsuiting als de repressie tegen bloggers als Kareem. Het gaat er inderdaad om dat Mubarak bezig is de Egyptische oppositie (over het gehele politieke en religieuze spectrum) uit te schakelen. Het stilzwijgen over de repressie van de islamisten terwijl liberale opposanten veel morele verontwaardiging als steun ontvangen, getuigt van willekeur en hypocrisie stelt Lynch. Hij stelt terecht dat iedereen die daadwerkelijk betrokken is bij mensenrechten, democratie en vrijheid van meningsuiting dit bredere perspectief in ogenschouw moet nemen.

A study of medieval Islamic art has shown some of its geometric patterns use principles established centuries later by modern mathematicians.

Researchers in the US have found 15th Century examples that use the concept of quasicrystalline geometry.

This indicates intuitive understanding of complex mathematical formulae, even if the artisans had not worked out the underlying theory, the study says. (more…)

Banning the burqa

The Dutch Islam debate may have seem to be calmed down a little during the last year, every now and then the same old themes come back again such as the Row over Dutch Muslim ministers with dual nationality.

Another issue the already came up last year and has sparked some debate again is the burqa-issue. Twice already, a majority in parlaiment has urged the cabinet arrange a complete ban on wearing burqas in public. According to the newly appointed social-democratic minister of integration, Ella Vogelaar, argued however that women should be allowed to wear burqas in some circumstances, for instance on the streets. She thinks it is desirable if women with burqa’s were working in public functions or jobs in which human contact was important.

Christian democrat CDA MPs Mirjam Sterk and Wim van de Camp have asked the minister to explain what steps she will take to stop the wearing of veils and other concealing clothing in the situations she deems unadvisable.
According to PVV-leader Geert Wilders the proposed ban does not  only apply at work but also on the streets. Wilders hopes to work with coalition party CDA and opposition party Liberal VVD in preparing the bill. Both these parties have supported Wilders’ motions so far towards banning the wearing of burqas in public. The new coalition parties Labour PvdA and ChristenUnie have opposed the motions. The coalition accord however does not state that such a ban will be introduced.

Een aardige impressie van een recent debat op DNR door Floor Milikowski
Sinds het instorten van de Twin Towers op 11 september 2001 is de naam Al-Qaeda niet meer weg te denken uit kranten, tijdschriften, radio- en tv-programma’s. Bij het oprollen van terroristische cellen, bij iedere aanslag en bij elke nieuwe dreiging, leggen de media direct een link met Al-Qaeda en indirect met Osama bin Laden. Het is de vraag of dit terecht is. Bin Laden is zijn macht grotendeels kwijt en van het oorspronkelijke Al-Qaeda is niets of weinig meer over.

In De Balie in Amsterdam bogen verschillende deskundigen zich onlangs over de vraag: ‘Waar is Al-Qaeda?’. Over wie hebben we het, waar komt het vandaan en waar wil het heen?

Duidelijk werd dat Al-Qaeda een minder eenduidig begrip is dan veel mensen (willen) denken. Midden-Oostendeskundige Bertus Hendriks en de arabisten Hans Jansen en Roel Meijer wezen erop dat Al-Qaeda niet zozeer een organisatie of netwerk is, alswel een ideologie, een state of mind, een inspiratiebron en een vlag waaronder wordt geopereerd.

Schooladvies voor allochtonen

Veel aandacht voor het Amsterdamse onderzoek waaruit zou blijken dat allochtonen een te laag schooladvies krijgen. Kijken we naar de rapportages dan zien we dat dit beeld niet helemaal gerechtvaardigd is op basis van dat onderzoek. Dankzij Geert Wilders (en wellicht ook dankzij het optreden van de kamervoorzitter) is de kwestie van dubbele nationaliteit weer eens terug in het multiculti-debat. Dit gebeurt met enige regelmaat. In een artikel in Migrantenstudies van Betty de Hart is zeer informatief voor deze discussie. Onderstaande is grotendeels op haar stuk gebaseerd (Deze entry mag dus gebruikt worden, maar altijd met een verwijzing naar haar stuk. De Amsterdamse Nieuwe Kerk paste catalogusteksten aan en schrapte een artikel over de Armeense genocide. Dit blijkt uit een artikel in het recente nummer van ZemZem, het tijdschrift over het Midden-Oosten, Noord-Afrika en islam dat verbonden is met onder andere de Nederlandse Vereniging voor de Studie van het Midden-Oosten en de Islam (MOI).
Het gaat daarbij onder meer om en artikel van turkoloog Jan Schmidt.Volgens Schmidt werd hem tevens verzocht passages te verwijderen over de aanwezigheid van Koerden in Istanbul, en over homoseksualiteit onder Osmanen. Een artikel over de genocide op de Armeniërs is geheel teruggetrokken, omdat de auteur niet wenste in te stemmen met de voorgestelde wijzigingen.Volgens woordvoerder Frans van der Avert van De Nieuwe Kerk is het artikel geschrapt, omdat de auteurs en de Turkse overheid niet tot elkaar waren te brengen. ‘Soms moet je na wederzijds overleg concluderen dat je er samen niet uitkomt. En we wilden, uit respect voor de auteurs en de Turkse overheid, niet tot een compromis komen.’ De catalogus is volgens hem verschenen ‘met respect voor elkaars opvattingen’.

Het bewuste artikel van Schmidt staat overigens in het recente nummer van ZemZem (in verkorte en gewijzigde vorm).

Children of the world: Unite! (and come to the Netherlands all of you)

It may come as a surprise to some of my readers but I really do believe the Netherlands is a great country. You can talk about a lot of things, most people are rich, social services are quite well and fair and balanced and the nature is very nice. I like it so much that I would like to invite everyone; dealing with all of joy on my own is selfish don’t you think so? And now it seems that in particular children have to come here because according to the Unesco Dutch children are the most happiest children in the whole world. Isn’t that great!

Now we can analyze why this is the case but I will leave that to others. Besides the questions asked by Ingrid Robeyns at Crooked Timber, I will leave it at how do you measure happiness and does it mean the same everywhere?

The best strategy to combat violence against women is to get organized and form a wider international solidarity platform, concludes Sabra Bano, director Gender Concerns International as the chair of the discussion on the theme of personal and political dimension of violence against women and the Role of Migrant Women in Europe.

The Discussion Forum was organized by Dona Daria, Rotterdam and Gender Concerns International, The Hague on 5th February. The chief guest Dr. Nawal El Saadawi linked all forms of violence against women to the development of patriarchy and talked about the diminishing of matriarchal society. She referred to various forms of defacing and disfiguring of a female body as a systematic and pre-calculated practice to mutilate women’s power over their brains. Referring to violence she mentioned about her experience as from being a young Egyptian village girl to becoming an author of 43 books, receiving many international prestigious awards and to the candidacy for the presidential post in the last election in Egypt.

“The price for freedom of expression on issues that raise the public opinion and potentially can unite people to demand justice is always too high”, Says El Saadawi. Even at the age of 76 now Dr. Nawal el Saadawi was brought to a court in Cairo on 28th January this year, she disclosed, answering a question during the discussion.

Other Speakers as Drs. Suaad Abdulrehman and Belgi Ahmetaj spoke about the efforts of migrant women in Europe to combat personal and political violence against women and emphasized the need for forming and strengthening Solidarity Actions to address all forms of violence against women. At this occasion the need to highlight the violence against those women that are caught in various political conflicts was emphasized. In particular the situation of women in Kashmir who suffer 60 years of invisibility of violence and abuse was discussed in detail and the initiative to launching the Hello Sirs! Campaign was considered important and timely. Prior to the discussion the Forum was opened up by the welcoming address of Gerda Nijssen, director Dona Daria. The hall was full to its capacity and the audience-panel interaction was excellent during the question-answer session. It was a well organized, fruitful and an inspiring event.

The latest Clingendael Security Paper, ‘Jihadi terrorists in Europe’, aims to contribute to a better understanding of the individuals and networks that have been behind jihadi terrorist activities in Europe (31 foiled and ‘successful’ plots and attacks between September 2001 and September 2006). To this end, it identifies about 250 terrorists and their networks, and investigates their characteristics and the circumstances under which they joined the violent jihad. (more…)

Het Nederlands Dagblad wist afgelopen wek te melden dat er zo’n 20 ‘radicaal-islamitische’ jongerenpredikers actief zijn in de regio. Deze zouden een niet gewelddadige vorm van het salafisme verspreiden. Ze zouden niet alleen actief zijn in de Randstad maar, en in toenemende mate, ook in de regio: Amersfoort, Apeldoorn, Assen, Breda, Culemborg, Den Bosch, Ede, Enschede, Gouda, Heerlen, Leerdam, Roermond, Tiel en Utrecht. De bijeenkomsten worden bezocht door vooral Marokkaanse jongeren tussen de 16 en 25 jaar. De predikers zouden werken vanuit bestaande salafistische centra zo blijkt in het ND: As Soennah-moskee in Den Haag, de El Tawheed-moskee in Amsterdam en de Al Fourqaan-moskee in Eindhoven. De lezingen zouden gematigd zijn met een sterk anti-westerse boodschap (interessante combinatie?).
Deze predikers zouden moeilijk aan te pakken zijn zo blijkt uit antwoorden van de minister naar aanleiding van Kamervragen.
